1. General Provisions
1.1 These Terms and Conditions of Use ("TCU") govern the use of the Majestic Boards online store accessible at majesticboards.com ("Store").
1.2 The Store is operated by Majestic Boards, W. Jagiełły 3, 98-200 Sieradz, Poland.
1.3 By using the Store, you agree to comply with these TCU. If you do not agree with any part of these TCU, please do not use the Store.
2. Glossary of Definitions
2.1 "Electronic Mail Address" means a designation of the ICT System that allows communication by electronic means.
2.2 "Personal Data" refers to all information concerning an identified or identifiable natural person processed by the Service Provider to provide Services specified in these TCU, conclude and perform a sales contract, and for statistical purposes.
2.3 "Registration Form" means a form filled out by the Registrant to set up a Client Account.
2.4 "Customer" means any individual or entity using the Online Store.
2.5 "Consumer" means a natural person purchasing the Goods for a purpose unrelated to professional or business activity.
2.6 "Customer Account" means a login assigned to the Customer (email address) and a password chosen by the Customer, which allows the Customer to make orders, view order history, subscribe to the Newsletter, and change given data.
2.7 "Login" means the email address entered by the Customer during account creation, allowing for later identification when using the online store.
2.8 "Newsletter" means a service provided by Majestic Boards, consisting of cyclically sending information, including commercial information, to the email address or phone number indicated by the Customer.
2.9 "Regulations" refers to these Regulations of the online store.
2.10 "RODO" refers to Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data.
2.11 "Store" or "Online Store" means an online platform for the sale of Goods under the terms of these Regulations, operating at majesticboards.com.
2.12 "Seller" refers to Majestic Boards, W. Jagiełły 3, 98-200 Sieradz, Poland.
2.13 "ICT System" means a set of cooperating IT devices and software ensuring processing and storage, as well as sending and receiving data via telecommunication networks.
2.14 "Means of Electronic Communication" means technical solutions, including ICT devices and cooperating software tools, allowing individual communication at a distance using data transmission.
2.15 "Goods" refers to products that can be purchased through the Store.
2.16 "Personalized Goods" refers to Goods available in the Store with the possibility of individual imprinting on the Customer's order.
2.17 "Contract" means a contract for the provision of electronic services between the Service Provider and the Client.
2.18 "Sales Contract" means a sales contract within the meaning of the Civil Code, concluded between the Seller and the Customer.
2.19 "Services" refers to services provided by the Service Provider to the Customer through the Store.
2.20 "Service Provider" refers to Majestic Boards, W. Jagiełły 3, 98-200 Sieradz, Poland.
2.21 "UŚUDE" means "act on Provision of Services by Electronic". It refers to the Act of July 18, 2002, on the provision of services by electronic means.
2.22 "Order" refers to a Service that allows customers to place an order for the purchase of Goods through the online store.
3. Services Provided by Electronic Means
3.1 The Service Provider provides the following Services electronically through the Store:
- Customer Account
- Order
- Basket
- Newsletter
3.2 The use of the Store Services is free of charge.
3.3 To set up a Customer Account in the Store (registration), the Customer must provide Personal Data marked as mandatory, choose a password, accept the TCU, and click the "Register" button. The Customer's Login is the Electronic Mail Address provided during registration.
3.4 Logging into the Customer's Account in the Store is done using the Electronic Mail Address provided during registration and a unique password.
3.5 The Contract is concluded when the Customer receives confirmation of proper registration in the Store, sent by the Service Provider to the email address provided by the Customer.
3.6 The Customer may delete his/her Customer Account at any time by sending an email requesting its deletion to: shop@majesticboards. Upon deletion, the Customer Account service agreement shall be terminated.
3.7 The Service Provider may terminate the contract for the provision of the Customer Account service with 14 days' notice, for reasons indicated. The termination will be communicated to the email address used during registration.
3.8 For placing an Order, it is necessary to provide Personal Data marked as mandatory, such as address data, invoice data, and payment method.
3.9 The Order Service is a one-time service that begins when the "continue without registration" button is clicked and ends when the Order is completed or the Customer discontinues the Order.
3.10 The Service Provider provides a Shopping Cart Service to facilitate placing an order for Goods. Adding Goods to the Shopping Cart does not imply their reservation, but the Cart remembers the selected Goods even after the session ends or the Customer logs out.
4. Placing an Order and Concluding a Sales Contract
4.1 The Store sells Goods via the Internet.
4.2 Information about the Goods on the Store's websites, such as price, description, and technical parameters, constitute an invitation to conclude a contract.
4.3 Orders can be placed electronically through the Store's website 7 days a week, 24 hours a day.
4.4 To place an order, the Customer must select the desired Goods, provide necessary information, choose the method of payment and delivery, and agree to the TCU.
4.5 Placing an Order results in submitting an offer to conclude a Sales Contract. The Seller confirms receipt of the offer by sending a "New Order" message to the Customer's email.
4.6 The Sales Contract is concluded when the Customer receives the email: "The Order has been forwarded for execution".
4.7 Placed Orders are visible in the "order history" tab for Customers with an Account.
4.8 The Customer can modify or cancel the Order until it is processed by contacting the Store staff.
5. Technical Requirements
5.1 The use of the Store is possible if the ICT System used by the Customer meets the following minimum technical requirements:
- A computer or similar device with Internet access and a web browser (e.g., Internet Explorer 11+, Mozilla Firefox 20+, Chrome 40+, Safari 8+)
- JavaScript enabled in the web browser and cookies allowed
- Active email address
6. Customer Obligations
6.1 The Customer should use the Store in accordance with applicable laws and the TCU. It is prohibited to:
- Provide unlawful content (e.g., content that violates personal rights or other rights of third parties)
- Use the Store in a way that interferes with its operation
- Provide untrue personal information or violate the rights of third parties
7. Complaints
7.1 Complaints related to the use of the Store Services can be submitted in writing to the address: 3 W. Jagiełły St., 98-200 Sieradz, Poland, or by email to: shop@majesticboards.com
7.2 The Service Provider will consider complaints within no more than 14 days. The response to complaints will be provided in the form indicated by the Customer (in writing or by email).
8. Personal Data
8.1 The Service Provider processes Personal Data in accordance with the GDPR and the UŚUDE. Detailed information regarding the processing of Personal Data is provided in the Privacy Policy.
8.2 The Service Provider ensures the security of the processed Personal Data and has implemented measures to prevent unauthorized access and modification.
8.3 Providing Personal Data is voluntary but necessary for using the Services.
9. Final Provisions
9.1 Recording, securing, and making available to the Customer the important provisions of the Sales Agreement is done by sending a confirmation of the Order to the email address provided and delivering a fiscal receipt or VAT invoice with the shipment.
9.2 The Customer may access the TCU at any time via the link provided on the Store's website. The Customer also has the right to download and print the TCU.
9.3 Matters not regulated in the TCU shall be governed by the applicable provisions of Polish law, particularly the Civil Code and the Consumer Rights Act.
9.4 The Service Provider reserves the right to amend the TCU. Any changes to the TCU shall take effect no less than 14 days from the date of making them available on the Store's website.
Attachment No. 1 - Right of Withdrawal
Right of Withdrawal:
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day you or a third party indicated by you, other than the carrier, takes physical possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement sent to:

Consequences of Withdrawal:
In the event of withdrawal, we will reimburse the payment received from you, no later than 14 days from the day we are informed of your decision to withdraw. You will bear the direct cost of returning the goods.
